Pre-Trial
Information (Civil) Motion
Practice, Discovery and Settlement,
Pre-trial Conferences
1. Motion
Practice
Judge Stiehl
follows the Federal and Local Rules for the filing and disposition
of pretrial motions. Courtesy copies are not required unless
the motion is filed within one week of, or during, trial. All
motions are to be filed with the Clerk of the Court, not in
Chambers. Judge Stiehl will only hold oral argument on motions
if he determines, after review of the pleadings, that argument
is warranted. All motions should be accompanied by a proposed
order. Substantive motions should be accompanied by a legal
memorandum in support of the motion.
2.
Discovery and Settlement
Discovery matters and settlement conferences are conducted by
the Magistrate Judges, and not by Judge Stiehl.
3.
Pretrial Conferences
Judge Stiehl will hold a Final Pretrial Conference on all Track
B and C cases. A Final Pretrial Order, prepared by the plaintiff
with the cooperation of all other parties is to be presented
for filing at the Final Pretrial Conference. Form copies of
the Final Pretrial Order format are provided to counsel at the
time of the initial scheduling and discovery conferences. The
form may be downloaded by linking to "Final
Pretrial Order Form." The parties may file Trial Briefs
addressing specific matters which are expected to arise during
the trial at the time of the Final Pretrial Conference.
